PAYMENTS TERMS:

Payment is due in full at booking, and at the latest before the commencement of the flight. Acceptable payment methods are by cash, wire transfer, check, or credit card (Visa, MasterCard, Discover, American Express).

CANCELLATION POLICY:

For cancellation by the customer more than 24h prior to the scheduled departure time and date, the payments are fully refundable.

For cancellation by the customer less than 24h prior to the scheduled departure time and date, the payment is still applicable toward a rescheduled flight at a later date if agreed-upon between the customer and the operator. Otherwise, a cancellation fee of 15% will be charged by the operator.

In all cases, if a repositioning flight is required before the scheduled flight, and has already started when cancellation is made, this portion of the flight will still be charged, as well as the return flight.

For changes in itinerary requested by the customer, prior agreement will have to be made for the new itinerary, and the operator will make its best effort to meet the new requests, but will solely determine the feasibility of the new itinerary. In case the operator determines that the flight is not possible for any reason, the mission will be considered to be cancelled by the customer.

SAFETY OF OPERATION:

Without limitation, Client acknowledges and agrees that the aircraft operator and its pilot-in-command will be solely responsible for all decisions regarding safety determinations with respect to the commencement, operation and termination of flights.

Passengers are expected to exhibit proper conduct, and comply with the operator instructions for the safe conduct of the flight. Interference with a flight crew is a federal offense.

PROHIBITED ITEMS:

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124).
Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.
There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. For further information contact your air carrier representative.

SECURITY REQUIREMENTS:

Clients acknowledges and agrees that all passengers meet the obligations set forth by the TSA, and will carry a photo identification card for the intended flights.

FORCE MAJEURE:

Harvard Air Taxi, LLC will not be deemed to be in breach of its obligations hereunder or have any liability to Client for any delay, cancellation or damage, arising in whole or in part, from any act of God, act of nature or weather, acts of civil or military authority, strike or labor dispute, mechanical or equipment failure, lack of essential supplies or parts, or for any cause beyond the direct control of Harvard Air Taxi, LLC.

DAMAGES:

Harvard Air Taxi, LLC shall have no liability or responsibility for delay, cancellation or failure to furnish any service to be provided to Client when caused by mechanical difficulty, weather conditions, acts of God, war, civil commotion, strikes or labor disputes, government regulation, law, rule or authority, or any causes beyond their reasonable respective control. Client assumes all responsibility and liability for Client and Client’s passengers/invitees safety, schedule, baggage, cargo, business and personal activities and financial ramifications associated with Client’s air travel performed by Harvard Air Taxi, LLC. Client and/or Client’s agents, passengers, guests or employees shall not engage in any act or possess any substance or allow cargo to contain any substance which may result in the seizure or forfeiture, or damage to or unsafe operation of the aircraft used in the air transportation operation conducted for Client by Harvard Air Taxi, LLC.

Client agrees to indemnify and hold harmless Harvard Air Taxi, LLC, it’s affiliates and all of their officers, directors, employees, members, legal representative, and any other agents, successors and assigns (the “Indemnified Parties”) from and against any and all liabilities, losses, damages, penalties, costs and expenses on account of any claim, suit, action, demand, proceeding or anything of a similar nature made or brought against any of the Indemnified Parties as a result of any act or omission on the part of the Client or any of its passengers.

REGULATIONS:

This Agreement and the services to be provided to Client hereunder are subject to all applicable rules, regulations, approvals and certifications in effect from time to time including, but not limited to, those promulgated by the FAA which now or hereafter may be imposed or required. This Agreement is governed by the law of the State of Masssachusetts and the federal transportation code. The illegality or non-validity of any paragraph, clause or provision contained or referred to in this Agreement shall not affect or invalidate any other paragraph or provision hereof. It is understood and agreed that this Agreement contains the entire agreement of the Client and Harvard Air Taxi, LLC with respect to the subject matter hereof. No terms or provisions of this Agreement may be changed except by written instrument signed by both parties.

Client accepts an agrees to the terms and conditions of Harvard Air Taxi, LLC Air Transportation Agreement.
